“At-will” employment means you can be fired for almost any reason: but not an illegal one. Wrongful termination usually means being fired because of a protected characteristic (race, sex, age 40+, disability, religion and more), in retaliation for complaining or whistleblowing, for taking protected leave, or in breach of a contract.

Signs you may have a case

  • You were fired soon after complaining about harassment, discrimination, wage problems or safety.
  • You were fired after requesting an accommodation or medical/family leave.
  • Comments about your age, race, pregnancy or another protected trait came before the firing.
  • You had a contract that limited firing to “cause.”

Discrimination claims usually require filing a charge with the EEOC (or your state agency) within 180 or 300 days, depending on your state. Don’t wait.

  1. Write down a timeline with dates, names and what was said.
  2. Keep copies of performance reviews, emails and texts you’re allowed to keep.
  3. Don’t sign a severance agreement before understanding what you’re giving up.
  4. Apply for unemployment benefits.
